Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of all mobile applications, websites, APIs, and related services developed and operated by Orion Designs LLC, 6513 Harold Ave, Cocoa FL 32927 USA ("Orion," "we," "our," "us"). Our applications include, but are not limited to:

Metric – a health- and fitness-focused mobile application;
Ignition – a rocket launch tracker and space event notification application;
Cove – a photo and video sharing social networking application.

Each application listed above, together with any associated websites, APIs, and services, is referred to individually as an "App" or "Application" and collectively as the "Applications" or "Service." By installing, registering with, or otherwise using any of the Applications, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

1. Acceptance of Terms

You affirm that you are at least 13 years old (or the minimum age of digital consent in your jurisdiction) and capable of entering into a binding contract. If you access the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. License Grant & Intellectual Property

Subject to your compliance, Orion grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to download and use the Applications for personal, non-commercial purposes. All trademarks, copyrights, and other intellectual-property rights remain the exclusive property of Orion or its licensors.

Prohibited actions include (without limitation):

copying, decompiling, reverse-engineering, or modifying the Applications;
creating derivative works based on any portion of the Applications;
removing or altering proprietary notices;
circumventing any security or usage-rules features.

3. Accounts, Security & Eligibility

You must provide accurate information when creating an account and keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use or security breach.

4. User-Generated Content

You retain ownership of content you post across our Applications (including but not limited to status updates, workouts, photos, videos, comments, leaderboard submissions, launch comments, and community contributions). By submitting content you grant Orion a worldwide, non-exclusive, royalty-free, sublicensable license to use, display, reproduce, distribute, and adapt that content for the purpose of operating, improving, and promoting the Applications.

You are solely responsible for your content and for ensuring that you have all necessary rights to post it. Do not upload content that is illegal, infringes others' rights, or violates these Terms.

5. Metric: Leaderboards & Social Features

Metric includes public or semi-public leaderboards that rank users on various performance metrics (e.g., VO₂ max, ageing-rate score). By participating in these features you expressly consent to:

the display of your display name, profile photo, aggregate statistics, and ranking position to other users (or, if marked "Public," to anyone with a share link);
the processing of supplied health and activity data necessary to calculate those rankings;
our right to adjust or remove leaderboard data we deem inaccurate, fraudulent, or obtained in violation of these Terms.

You may opt-out of leaderboards at any time in App → Settings → Privacy. Opting-out will remove your ranking from public view but does not delete the underlying activity data, which remains available for your private analytics unless you delete it.

Leaderboard results are provided "as is" for entertainment and community engagement only; they confer no monetary prize, certification, or legal right. Algorithms and scoring formulas may change without notice.

5A. Ignition: Launch Data & Notifications

Ignition provides rocket launch schedules, countdowns, notifications, and related space event information. By using Ignition you acknowledge and agree that:

Launch schedules are subject to change at any time due to weather, technical issues, range conflicts, regulatory requirements, or other factors beyond Orion's control;
Orion sources launch data from publicly available space agency feeds, third-party databases, and official launch provider announcements, and cannot guarantee the accuracy, completeness, or timeliness of this information;
you should always verify launch times with official sources (e.g., NASA, SpaceX, ESA, JAXA, Roscosmos) before making travel, viewing, or other plans based on information displayed in Ignition;
Orion is not liable for any losses, damages, or inconvenience arising from inaccurate, delayed, or missed launch information;
push notifications may be delayed due to network conditions, device settings, or other technical factors outside Orion's control.

Ignition is not affiliated with, endorsed by, or sponsored by any space agency, launch provider, or aerospace company unless explicitly stated within the Application. All launch provider names, rocket names, and mission names are trademarks of their respective owners and are used for informational purposes only.

5B. Cove: Photo & Video Sharing

Cove is a platform for users to share photos, videos, and social updates. By using Cove, you acknowledge and agree that:

you are solely responsible for the content you upload, including ensuring you have the necessary intellectual property rights and permissions;
we reserve the right to review, monitor, and remove any content that violates these Terms or our community guidelines;
content shared publicly on Cove may be viewed, redistributed, and interacted with by other users of the Application.

6. Health, Safety & Information Disclaimers

Metric (Health & Fitness)

Metric provides fitness-tracking and social features for informational purposes only. It is not a medical device and does not provide medical advice. Consult a qualified healthcare professional before starting any exercise program. You assume all risk associated with physical activity logged or guided by Metric.

Ignition (Rocket Launch Tracker)

Ignition provides space event and launch information for informational and entertainment purposes only. If you attend a rocket launch in person, you are solely responsible for your own safety and must comply with all applicable laws, regulations, and safety guidelines established by launch site operators, local authorities, and government agencies. Orion assumes no responsibility for your safety at any launch viewing location.

Cove (Social Networking)

Cove is a platform for sharing user-generated media. Orion does not endorse any user-submitted content and disclaims any responsibility or liability for such content. You may encounter content that may be offensive, inappropriate, or misleading, and you assume all risks associated with viewing and interacting with such content.

General

All Applications and their content are provided for informational purposes only. Orion makes no warranties regarding the accuracy, reliability, or suitability of any information provided through the Applications.

7. Subscriptions, Fees & Payment

Our Applications may be offered on a freemium basis, with optional premium features available for purchase. In-app subscriptions and one-time purchases are processed by Apple App Store or Google Play ("App Stores"). Prices, billing cycles, and renewal terms are disclosed at the time of purchase. Subscriptions renew automatically until cancelled in your App Store account settings at least 24 hours before the end of the current period. Refunds are handled by the App Stores and are subject to their policies and applicable law.

8. Privacy

Your use of the Service is subject to ourPrivacy Policy, which explains how we collect, use, and protect your data.

9. Third-Party Services & Links

Our Applications integrate with third-party platforms and data sources. These include, but are not limited to:

Metric: Apple HealthKit, Google Fit, Garmin Connect, and other fitness platforms;
Ignition: Space agency APIs, launch provider feeds, third-party launch databases, and publicly available space event information sources.

The Applications may also contain links to third-party websites. Orion is not responsible for third-party content, data accuracy, or practices. Your use of third-party services is governed by their respective terms and privacy policies.

10. Prohibited Conduct

When using any of our Applications you agree not to:

violate any applicable law or regulation;
post violent, hateful, harassing, or sexually explicit content;
upload malware, viruses, or other malicious code;
harvest or scrape data from the Applications;
impersonate another person or misrepresent your affiliation;
use the Applications while driving or in situations requiring full attention;
submit false, artificially inflated, or automated fitness data intended to manipulate leaderboards (Metric);
submit false, misleading, or fabricated launch information or community contributions (Ignition);
use launch data obtained through Ignition for commercial purposes without express written permission from Orion;
access or use the Applications in sanctioned or embargoed countries.

11. Software Updates & Availability

We may deploy updates, bug fixes, or new versions to our Applications automatically. You consent to receive such updates. We are not liable for any failure to provide updates or for any incompatibility with your device or operating-system version.

12. Disclaimers of Warranties

To the fullest extent permitted by law, the Applications are provided"as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Applications will be uninterrupted, secure, or error-free.

Without limiting the foregoing, we make no warranty regarding the accuracy, timeliness, or completeness of any health metrics, fitness data, launch schedules, or other information displayed in the Applications.

13. Limitation of Liability

To the maximum extent permitted by law, Orion and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of (or inability to use) the Applications, even if we have been advised of the possibility of such damages. Our aggregate liability for all claims will not exceed the greater of (a) one hundred US dollars (USD $100) or (b) the amount you paid us in the 12 months preceding the claim.

This limitation applies to all claims, including but not limited to claims arising from inaccurate launch data, missed notifications, health data discrepancies, or any reliance on information provided by the Applications.

14. Indemnification

You agree to indemnify and hold harmless Orion, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your breach of these Terms or your misuse of the Applications.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles.US residents: Any dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in class-action litigation.

Non-US residents: You may bring claims before the competent courts of your habitual residence or Florida, USA, unless local law grants you mandatory consumer-protection venues.

16. Export & Sanctions Compliance

You may not use, export, or re-export the Applications except as authorized by United States law and the laws of the jurisdiction in which the Applications were obtained. You represent that you are not located in, and are not a national of, any country subject to U.S. government embargo or sanctions.

17. Termination

We may suspend or terminate your access to any or all Applications at any time for any reason, including breach of these Terms. Upon termination:

the license granted to you will end;
you must stop using the affected Applications and delete all copies.

18. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated in-app or via e-mail at least 15 days before they take effect. Continued use after the effective date constitutes acceptance.
